We are seeking feedback on Council's intention to acquire Lot 97 on Plan of Subdivision 735241D, which is located in a new residential subdivision on Packham Drive in Cobram. All of the land contained in this parcel comprise easements in favor of Council and if acquired will be designated as a Council reserve.
Background information
A subdivision development has occurred and in the process a legacy issue has arisen due to Council approving a Planning Permit amendment which affected the already created Lot 97.
The intent of the Planning Permit amendment conditions was for Lot 97 to be handed over to Council however Lot 97 had already been created on the plan of subdivision for Stage 1 of the subdivision. All of the land contained in this parcel comprise easements in favor of Moira Shire Council.
Due to the current classification of the lot, it cannot be transferred to Council in the usual planning permit process. A separate process is required in accordance with Section 112 of the Local Government Act (the Act) and in accordance with Council’s Community Engagement Policy.
