Contractors and native vegetation
It is illegal to remove, destroy or lop native vegetation, unless you have a permit or approval to rely on an exemption. Activities that result in the loss of native vegetation includes the disturbance of the earth around the base of a tree (within 15m). Any person who fails to comply with the Act may be found liable.
It is also illegal to destroy wildlife habitat or cultural heritage.
If you are contacted by a landholder to undertake works it is your responsibility to ensure the works are legal. You can do this by checking that a planning permit has been secured for the planned activity, or evidence that the landholder has approval to rely on an exemption.
You, your employees or your company may be liable for any offences under the Act (Section 126). Council enforces the native vegetation regulations and holds all parties accountable including landholders and contractors. Enforcement actions for contractors may include:
- Issuing of an Official Warning;
- Issuing of a Penalty Infringement Notice (which incurs a financial penalty); and
- Removal of contractors from our preferred supplier list.
